Following are several links to Wyndham-related
lawsuits on behalf of owners. Many of
these are against Wyndham’s other brands or subsidiaries (Trendwest, WorldMark,
RCI, etc.): Here is a
link to the RCI Class Action Settlement Agreement, dated Nov 21, 2008, which
finds Wyndham subsidiary company, RCI, to have used timeshares deposited with
them for exchange, and rented them to the public without knowledge or approval
of owners. Said deposits were rented to
the public for Wyndham’s own corporate benefit and once removed from inventory,
were no longer available for other owners to receive in

link to a Dec 10, 2008 finding against Wyndham to allow Worldmark (another
Wyndham membership program, similar to FairShare) owners’ access to the email
addresses so proxies may be sent to owners to try and overthrow their
Wyndham-controlled Board of Directors. It is item 8 in the list. Also notice
the part where the Board of Directors tried to amend their bylaws to disallow
this, even while the complaint and petition were pending! Here is a
link to the pending class action suit against Wyndham for monopolizing the Board
of Directors of WorldMark and devaluing their ownership. This is a different
membership program than FairShare, but the premises of the class action are very
similar. Actually,

much more information about the Worldmark class action suit and should prove
helpful in understanding how Wyndham is trying to use their corporate
relationships to manipulate the various organizations they are entrusted to
manage. Here's
another recent example. In December, 2008, the Property Owner's Association at
Daytona Beach Ocean Walk, which was managed by Wyndham, filed the largest civil
suit in Florida’s history (against Wyndham), again alleging misuse of the
resources the were supposed to manage, misuse of funds, and unwillingness to
relinquish assets even after being fired as the management
company. Additionally, there are several State Attorney
General’s who have taken punitive action on behalf of their constituents against
the timeshare industry, mostly for unfair sales and marketing practices. Here are four examples (one involving Wyndham
subsidiary, Worldmark): California
Attorney General Bill Lockyer sues Trendwest (a former

Attorney General Jay Nixon sues Branson timeshare developer. Notice paragraph four, which alleges that
specified promised benefits were not delivered.
This is one of the biggest concerns owners have with what Wyndham is

another lawsuit filed by Missouri Attorney General Jay Nixon last year – this

Corbett announced lawsuits against multiple Florida timeshare companies for
deceptive timeshare practices.
Everything Wyndham is currently doing to our ownership would certainly
